By registering for this GrainGrowers event, you agree to these terms and conditions.
GrainGrowers reserves the right, in its sole discretion and without liability, to cancel any registrations that do not comply with these terms and conditions, or if GrainGrowers considers that there is reputational risk to GrainGrowers. GrainGrowers reserves the right to update these terms and conditions without notice.
To the maximum extent permitted by law, GrainGrowers (including its directors, employees and affiliates) will not be liable to you, and are not responsible for, any loss or damage of any kind (including consequential loss), injuries, liabilities, claims or expenses that may arise from the event, including instances where GrainGrowers fails to comply with its obligations due to circumstances outside of its control, howsoever caused, whether in contract, tort including negligence, statute or otherwise arising in relation to the event.
To the maximum extent permitted by law, GrainGrowers excludes all representations, guarantees and warranties relating to your purchase of tickets for and attendance at our events, and GrainGrowers disclaims all liability and responsibility for communications, graphics, audio files or other information which are inappropriate, defamatory, offensive, harmful, inaccurate, dishonest or misleading and/or deceptive published by participants, sponsors or speakers. The information provided during an event is intended for general information purposes only. GrainGrowers does not warrant the accuracy of any information provided during an event. Any reliance you place on such information is strictly at your own risk.
By registering for this GrainGrowers event, you agree to indemnify GrainGrowers, its affiliates, employees, contractors and agents (the Indemnified) against all actions, proceedings, claims and demands which may be brought or made against the Indemnified by any person in respect of any loss, damage or injury (including death) occurring to any person or property arising out of or in connection with your attendance at, or involvement in an event. This indemnity includes any costs incurred by GrainGrowers (including legal costs) in defending any actions, proceedings, claims and demands or in being represented at proceedings, inquiries or inquests. All indemnities survive the termination of any relationship with you.
Nothing in these terms is intended to exclude, restrict or modify rights which you may have under any law (including in Australia, the Australian Consumer Law) which may not be excluded, restricted or modified by agreement. If these terms are governed by the Australian Consumer Law, our liability to you for failure to comply with a consumer guarantee in respect of any services is limited to the re-supply of the services or payment for such re-supply.
By registering for this GrainGrowers event, you consent to GrainGrowers (and any third parties it permits) using photographs, film and sound recordings of you (your Image) as part of material that it makes available under Creative Commons licences, online and in printed materials. You also consent to GrainGrowers (and any third party it permits) using your Image to promote GrainGrowers and GrainGrowers workshops and industry events, including in print, exhibitions, promotional material (including books and magazines) film and web related media, as part of a DVD or other release, and on GrainGrowers social networking sites and other social media platforms, with or without attribution to you. You agree that GrainGrowers does not have to make a payment to you if it uses your Image.
You understand that once your Image is made available online it is possible that it may be accessed, used, modified, copied and distributed by any person, anywhere in the world, for any purpose. You agree that if GrainGrowers provides your personal information (including your Image or name) to any person outside Australia, GrainGrowers does not need to ensure that the person will comply with Australian privacy requirements.
Cancellation and payment policy
All cancellations must be made in writing to email@example.com. Cancellation by phone will not be accepted.
Cancellations received prior to Monday 15 April 2019, no charge.
Cancellation received on Tuesday 16 April 2019 to Friday 12 July 2019, a $50 administration fee will be charged.
Cancellations received after Friday 12 July 2019, refunds will not be issued. However, substitutions without charge will be accepted until Tuesday 16 July 2019.
If you are unable to attend an event after your registration has been accepted by GrainGrowers, you may request that another individual attends in your place (a Substitute Individual) at no extra charge, provided that your request is made in writing to the following email address, firstname.lastname@example.org. GrainGrowers reserves the right, at its absolute discretion, to accept or reject any request for a Substitute Individual, and any transfer of a registration is subject to the Substitute Individual accepting these terms and conditions.
GrainGrowers reserves the right to vary, amend or cancel any event without notice, including the date, time and location of any event. GrainGrowers is not liable for any travel, accommodation or other costs that you may have incurred in relation to the varied, amended or cancelled event.
All event registration fees must be paid at the time of registration and are [inclusive] of GST. Should GrainGrowers be required to cancel an event, GrainGrowers will notify you as per the details provided during registration and will use reasonable endeavors to offer a refund of monies paid (exclusive of booking fees).
All event registrations are subject to venue capacity. GrainGrowers reserves the right to refuse registration if the event has reached capacity.
GrainGrowers reserves the right to alter the program prior to or during the event without notice. GrainGrowers will endeavor to ensure the program and schedule is correct at the time of posting. GrainGrowers does not take any responsibility for any errors or omissions to the program or schedule of the event. Please note: not all speakers choose to provide presentation papers.
The intellectual property used in connection with the event, including (without limitation) any text, graphics, photographs, logos or trade marks is owned or licensed by GrainGrowers or the speakers or presenters, unless indicated otherwise.
Code of conduct
By registering for this GrainGrowers event you are expected to behave in a professional and appropriate manner. GrainGrowers reserves the right to refuse entry to any event or remove the participant from the event premises if their behaviour is deemed inappropriate, disruptive, unacceptable or if the participant is intoxicated. GrainGrowers does not tolerate online or in person, harassment or discrimination of other participants.
Event attendees must be over 18 years of age (unless otherwise specified) and proof of age may be asked at any time. GrainGrowers staff reserve the right to refuse entry to anyone in breach of the code of conduct and to deny access to future GrainGrowers activities.
Delegates need to secure their own travel and health insurance. GrainGrowers accepts no responsibility for accident or misadventure including flight cancellations or lost property.
These terms and conditions are governed by the laws of New South Wales, Australia. Both you and GrainGrowers submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
If any provision of these terms and conditions is deemed invalid or unenforceable, all or part of that provision will be severed from these terms and conditions and will not affect the enforceability of the remaining provisions of these terms and conditions.
No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Any failure to assert any right under these terms and conditions shall not constitute a waiver of such right.
